Trump’s Executive Order – What It Means to You

executive_order__1_President Trump signed an Executive Order that instructs several agencies of the U.S. government to “consider” changes to parts of ObamaCare. It is likely that the agencies will not only “consider” the instructions but will act upon them. However, it likely will not happen for at least 60 days.

At Pivot Health we have been very involved in this process, and have commented and been quoted in places like The Wall Street Journal, Associated Press, USA Today, Washington Post and ABC News.

Here is what will likely happen:

  1. Starting at some point after January 1, 2018 (perhaps February 1), the order that limits short term medical plans to 90-day duration will be overturned by federal agencies. This means that in many states plans that are sold after that date can have a duration as long as 364 days. At Pivot Health we are already preparing for this, and will likely have options that deliver even better news to consumers. Pivot Health is an established leader in short term medical, and, in most states, our clients already can have the protection of up to 360 days of coverage. There is no need for them to change coverage.
  2. The concept of “selling insurance across state lines,” which is also known as “association health plans” will have an opportunity to grow and be exempt from many of the requirements of ObamaCare. Although this could be good news for consumers at some point in time, it is unclear when, how, or if such plans will operate, who will regulate them, and whether they will be challenged in the courts.
  3. Finally, the Executive Order expands the use of health reimbursement accounts (HRAs). This will help small employers who want to offer individual health plans to their employees in lieu of a small group plan. The full impact of this will likely be subject to regulatory review. While it is certainly not bad news for consumers and small business owners, it might not be that big of a deal.

What should advisors and brokers do? Don’t rush to make changes based on proposed rules and the Executive Order. There are favorable winds, but the ship is not yet at the dock. Advise your clients to not rush to judgment based on the partial-truth reported by the media. Health insurance is complicated, and the mainstream media likes to turn proposed changes into brief sound bites, or even briefer tweets.

In addition, the President announced that he would end funding for cost-sharing reduction subsidies (CSRs) for those lower income Americans who buy ObamaCare plans. The CSRs reduced deductibles for those who earn less than 250% of the federal poverty level. This move makes our Latitude product that fills gaps in high deductible plans a very appealing ‘”fix.”

This is good news for consumers – good news for agents and advisors – and a wonderful start to all those who are supporting the Pivot Health initiative.
